Privacy Policy

As an Internet Service Provider and Carrier Service, Wackado Internet Services is bound by the Telecommunications Act 1997 and has adopted the national privacy principles as set out in the Commonwealth Privacy Act 1988.

NPP1 – Collection :

WIS collects personal and non-personal information such as, but not limited to, the following :

    • Your name / business name,
    • Postal address,
    • Phone / fax number,
    • Username and passwords,
    • Billing information,
    • Internet usage records,
    • Credit card details.

If you do not provide WIS with all the requested information we may not be able to offer you the services for which you have subscribed.

When it is practicable to do so WIS will collect information directly from the individual. This information is only collected by lawful and fair means and not in an unreasonably intrusive way. Several ways in which we may collect this information are :

    • Directly from you in person, by telephone, mail, fax, Email, or Internet,
    • From our own records from your use of services and products,
    • From publicly available sources,
    • From third parties such as credit reporting agencies or your authorised representative/s.

At the time of collecting the personal information or as soon as practicable after we will endeavour to make the individual aware of :

    • The identity of WIS and contact details,
    • The fact that he/she is able to gain access to the information,
    • The purposes for which the information is collected,
    • The organisations (or types of organisations) to which WIS may disclose information of that kind,
    • Any law that requires the particular information to be collected,
    • The main consequences (if any) for the individual if all or part of the information is not provided.

NPP 2 – Use and Disclosure :

WIS is committed to protecting your privacy. We will not use or disclose your personal information unless :

    • You have specifically authorised the disclosure,
    • You would reasonably expect us to do so,
    • We are required or authorised by law,
    • We suspect that unlawful activity has been, is being or may be engaged in, and need to report our concerns to the relevant persons or authorities,
    • It is necessary by or on behalf of an enforcement body.

Our primary purpose for collecting personal information is to enable us to provide your with a quality Internet services and for the purpose of billing for these same services.

We may also use your personal information for other purposes directly related to our primary purpose, such as answering your queries/complaints and trying to improve services and products. Your personal information may also be used for other purposes which you would reasonably expect us to do so.

NPP 3 – Data Quality :

WIS will take all reasonable steps to ensure that the personal information collected, used and /or disclosed is accurate, complete and up to date.

However, it is the responsibility of the individual to provide WIS with any change of details necessary, such as change of address, other contact details or errors. The contact details for WIS are at the end of this document.

NPP 4 – Data Security :

WIS will take all reasonable steps to ensure that the personal information which it holds from misuse and loss and from unauthorised access, modification or disclosure. Any personal information which is not longer required will be destroyed or permanently de-identified.

NPP 5 – Openness :

WIS will take all reasonable steps to inform individuals, generally, what sort of personal information it holds, for what purpose/s, and how it collects, holds, uses and discloses that information.

NPP 6 – Access and Correction :

You have the right to request access to, or to obtain copies of your personal information which WIS may hold.

If we can properly identify the caller this information may be able to be given over the telephone, otherwise the request must be put in writing with the clients signature and any other identifying information required to prove the clients identity. Depending on the information requested and the difficulty of collecting/collating it there may be a waiting period. However, we will endeavour to respond to all requests within 30 days. We reserve the right to charge a fee for the supply of any such information but this :

    • Will not be excessive,
    • Will not apply to lodging a request for access.

There may be times when we cannot give you access to personal information. Some such examples are :

    • You have outstanding accounts with WIS,
    • Unlawful activities are under investigation,
    • Other peoples privacy may be at stake.

WIS will provide reasons for denial of access or a refusal to correct personal information.

NPP7 – Identifiers :

WIS will not adopt as its own identifier of an individual, an identifier of the individual that has been assigned by :

    • An agency, or
    • An agent of an agency acting in its capacity as agent, or
    • A contracted service provider for a Commonwealth contract acting in its capacity as contracted service provider for that contract.

NPP 8 – Anonymity :

Where ever it is lawful and practicable, individuals will have the option of not identifying themselves when entering transactions with WIS. However, in most cases this will not be practicable when requesting access to Internet services.

NPP 9 – Transborder Data Flows :

WIS may transfer personal information about an individual to someone (other than WIS or the individual) who is in a foreign country only if :

    • WIS reasonably believes that the recipient of the information is subject to a law, binding scheme or contract which effectively upholds principles for fair handling of the information that are substantially similar to the NPP’s, or
    • The individual consents to the transfer, or
    • The transfer is necessary for the performance of a contract between the individual and the organisation, or for the implementation of pre-contractual measures taken in response to the individual’s request, or
    • The transfer is necessary for the conclusion or performance of a contract concluded in the interest of the individual between the organisation and a third party, or
    • All of the following apply,
    • The transfer is for the benefit of the individual,
    • It is impracticable to obtain the consent of the individual to that transfer,
    • If it were practicable to obtain such consent, the individual would be likely to it, or
    • The organisation has taken reasonable steps to ensure that the information which it has transferred will not be held, used or disclosed by the recipient of the information inconsistently with the NPP’s.

NPP 10 – Sensitive Information :

WIS will not collect sensitive information about an individual unless :

    • The individual has consented, or
    • The collection is require by law, or
    • The collection is necessary to prevent or lessen injury to any individual, or
    • The collection is necessary for a legal or equitable claim.
